Who Is Responsible?
Let's start off with this example:
If you have a tree on your property that is alive and well and is blown down by wind and:
- damages your home or structure:
- Your homeowners insurance policy will cover the damage to your home or structure (up to the policy limits) and the debris removal expense paid is normally up to 5% of your Dwelling Coverage A. Your deductible will normally apply.
- damages your neighbor's home or structures:
- Your neighbor's homeowners insurance policy should cover this loss, as it is looked at as an Act of God.
- does not damage any home or structure:
- There are normally limits on Debris Removal for around $500 per tree and $1000 per occurrence under some homeowners insurance policies. Some policies will only offer this coverage if your tree is blocking a road or entrance to your property. Your deductible will normally apply.
If you have a tree that is in poor shape and is dead or dying and falls and:
- damages your home or structure:
- The same coverage normally applies under your homeowners insurance policy.
- damages your neighbor's home or structures:
- You may be held liable for damages since you did not maintain your property and remove the tree, since it would now be a "risk".
Tree maintenance is the homeowner's responsibility. Be sure to note if a neighbor's tree is a risk to your property. We would suggest having a discussion with your neighbor (if possible) taking photos, and you may want to contact your local civil authority if the property owner is unwilling to remove the tree.
